The Renter confirms that he/she holds a valid driving license recognised in Malaysia and is legally permitted to drive the Vehicle.
Only the Renter named in this Agreement is authorised to drive the Vehicle unless Ventura gives prior written approval.
The Renter shall be fully liable for all loss, damage, fines, claims, insurance rejection, and legal consequences caused by any unauthorised driver.
The Vehicle must be returned on or before the agreed return date and time stated in this Agreement. Any extension must be requested 12 hours before expiry of the rental period and shall only be valid once approved by Ventura.
The security deposit shall not be used or adjusted as rental, extension, fine, or damage payment unless Ventura agrees in writing.
Ventura may deduct from the security deposit any unpaid rental, extension charge, damage cost, excess, fine, toll, cleaning fee, missing item, recovery cost, or other amount due.
The Renter shall use the Vehicle carefully, lawfully, and only for normal private road use within Malaysia unless otherwise approved in writing.
The Vehicle must not be used for illegal activity, racing, drifting, towing, off-road driving, e-hailing, delivery, courier service, sub-rental, or commercial use without approval.
Smoking, vaping, pets, illegal substances, and strong odours are strictly prohibited inside the Vehicle. Smoking/vaping inside the car will result in automatic violation of the agreement terms and an additional penalty of RM 200 will be implied.
The Vehicle must be returned with the same fuel level and in a clean, proper, and acceptable condition.
The Renter is fully responsible for all traffic fines, tolls, parking charges, summonses, penalties, and legal violations incurred during the Rental Period.
The Renter must complete Ventura's digital vehicle inspection within fifteen (15) minutes of handover by uploading clear and unedited photos of all required vehicle areas.
Any damage not clearly recorded in the digital inspection at handover shall be presumed to have occurred during the rental period of the Renter.
In case of accident, damage, theft, breakdown, warning light, tyre issue, police stop, or third-party claim, the Renter must immediately notify Ventura and fully cooperate.
This Agreement, including digital signatures, inspection photos, GPS data, timestamps, booking records, payment records, WhatsApp communications, and system logs, shall be governed by the laws of Malaysia and may be relied upon as evidence in any dispute, claim, or legal proceeding.
